Introduction
By using the Free Food Alert Application, I certify that I agree to all the terms & conditions and acknowledge that it is my responsibility to check these terms and conditions regularly because they may change.
The Free Food Alert Application (the "Application") is provided by Free Food Alert, a Limited Liability Company headquartered in Florida, United States of America. By downloading and/or using the Application or Website, you agree to be bound by these terms and conditions (the "Terms"). If you do not agree to the Terms, do not use the Application.
Use of the Application
The Application provides users with alerts regarding free food giveaways at the end of catered events hosted on their university campus in order to remediate food waste and curb hunger.
Conditions
- Eligibility: The Application is intended for use by individuals who are 18 years of age or older. If you are under 18, you may not use the Application.
- Rules & Warnings: I agree to observe and obey all posted rules and warnings, and further agree to follow any instructions or directions given by free food giveaway hosts.
- Inherent Risks: I recognize that there are certain inherent risks associated with participating in free food giveaways and assume full responsibility for personal injury to myself, and further release and discharge Free Food Alert and any associated event hosts for any injury, loss, or damage arising out of my use of the Application, whether caused by the fault of myself, Free Food Alert, or other third parties. I expressly agree that use of the Application is at my sole discretion and take responsibility for all risks, including, but not limited to:
- Dietary Restriction(s) and Allergen(s): Free Food Alert cannot guarantee that the food available during giveaways will be appropriate for any particular allergies or dietary restrictions, regardless of the information provided within alert and events posted in the Application. The giveaway host is responsible for providing accurate information for each alert.
- If you have a strict dietary restriction and/or allergies, it is not recommended to use the Application.
- Foodborne Illness: Free Food Alert cannot guarantee the quality or safety of food distributed through the Application notifications. Pick up, store, and consume free food from giveaways at your own discretion. The quality and safety of the food being given away is the sole responsibility of the free food giveaway host. Each Free Food Alert member organization has one or more Application administrators who are responsible for reviewing and approving free food giveaway host applications. ¨
- Free Food Alert operates under the assumption that all users hosting free food giveaways have been vetted by their organization admins and that they coordinate free food giveaways in good faith to decrease food waste and hunger.
- Accuracy of Alerts: Free Food Alert does not review alerts for accuracy before they are sent to subscribers and therefore cannot be held liable for any injury or detrimental outcome that results from inaccuracies in the posts for free food giveaways. The giveaway host is solely responsible for the accuracy of the information provided in their giveaway notifications.
- Privacy Policy: Your use of the Application is subject to the Free Food Alert Privacy Policy. By using the Application, you consent to the collection, use, and disclosure of your personal information in accordance with the Privacy Policy.
Governing Law: Any legal or equitable claim that may arise from use of the Application shall be resolved under Florida law in the United States of America. - Paragraph Headings: Paragraph headings are for convenience only and shall not be a part of the Terms and Conditions of this Agreement.
- Modification: Free Food Alert reserves the right to change these terms & conditions at any time without prior notice. Your continued use of the Application after any changes to the terms & conditions indicates your agreement to be bound by the revised terms & conditions.
- Severability: If any term or provision of these terms & conditions should be declared invalid by a court of competent jurisdiction, the remaining terms and provisions of these terms & conditions shall remain unimpaired and in full force and effect.
- Disclaimer of Warranties: The Application is provided on an "as is" and "as available" basis. Free Food Alert LLC makes no representations or warranties of any kind, express or implied, as to the operation of the Application or the information, content, materials, or products included in the Application.
- Limitation of Liability: Free Food Alert LLC will not be liable for any damages of any kind arising from the use of the Application, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
- Indemnification: You agree to indemnify, defend, and hold harmless Free Food Alert LLC and its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, costs, and expenses, including but not limited to attorneys' fees, arising from or related to your use of the Application.
- Agreement: I agree and acknowledge that I am under no pressure or duress to agree to these terms & conditions, and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review these terms & conditions if I so desire.
Intellectual Property
The Application and all content contained within the Application, including but not limited to text, graphics, logos, images, and software, are the property of Free Food Alert LLC and are protected by intellectual property laws. You may not use, copy, modify, or distribute the Application or any content contained within the Application without the prior written consent of Free Food Alert LLC.

Introduction
The Privacy Policy describes Free Food Alert policies and procedures on the collection, use and disclosure of your information in relation to use of the Application. Your personal data is used to provide you with alerts about free food giveaways on campus, in accordance with your subscriber preferences. Your data is also utilized to improve the Application. By using the Application, you agree to the collection and use of your information in accordance with this Privacy Policy.

The capitalized terms in this policy have specific meanings defined under the following conditions. Regardless of whether they appear in the singular or plural, these definitions shall have the same meaning.

You have the right to delete any personal data we have collected about you. You can do this by deleting your account at any time from your Account Settings. You may also Contact Us to request access to, correct, or delete any personal information that You have provided to Us. Please note, however, that we may need to retain certain information when we have a legal obligation or lawful basis to do so.
